These Terms & Conditions govern participation in all Aerialicious® activities, including online lessons, private tuition, workshops (national and international), and retreats (national and international). By enrolling, booking, or attending any Aerialicious® session or event, you agree to these Terms & Conditions and acknowledge the accompanying waiver and risk statement.

1. Bookings & Payment

Full details on our bookings and cancellations policy can be viewed here.

• Bookings can be made directly through our website, via approved third-party platforms (such as SuperSaaS), or by contacting Aerialicious® directly.

• All bookings require full payment upfront to confirm your place.

• Confirmation is issued once payment is received and a booking confirmation email has been sent.

• Payments are processed securely through third-party providers (such as Stripe).
  
  

2. Cancellations & Rescheduling

• Online Lessons & Private Tuition:

  • Cancellations made 24 hours or more in advance may be rescheduled.

  • Cancellations made within 12–24 hours are charged 50% of the session fee.

  • Cancellations made within 12 hours or “no-shows” are non-refundable.
    

• Workshops (National):

  • Cancellations made 7 or more days before the event may be rescheduled or credited.

  • Cancellations within 7 days of the event are charged 50% of the fee.

  • Cancellations within 48 hours or non-attendance are non-refundable.
    

• Retreats & International Workshops:

  • A non-refundable deposit is required to secure your spot.

  • 90+ days before retreat start: Deposit non-refundable; balance refundable.

  • 30–89 days: 50% of total payment refundable.

  • Less than 30 days: No refund.
    

• Refunds, if approved, will be processed via the same payment method used for the original booking.

• Aerialicious® reserves the right to cancel or reschedule sessions due to low enrollment, instructor illness, or unforeseen circumstances. In such cases, you will be offered an alternative date, credit, or full refund.

3. Health, Safety & Fitness

• Circus is a high risk activity. You must be in good physical condition to participate in aerial activities and disclose any injuries, medical conditions, or physical limitations prior to class, and you are cleared to exercise by your doctor or other medical professionals. 

• You agree to follow all instructor directions and safety procedures.

• Aerialicious® reserves the right to refuse participation if it deems it unsafe based on disclosed or observed health conditions. 

• A review by a medical professional and/or a medical certificate may be required for participation to proceed. Aerialicious® is not liable for any costs associated with attaining medical clearance and that these costs are the sole responsibility of the participant. 

• You understand that aerial and circus arts is a high risk activity involving inherent physical risks and that participation is at your own risk.
  
  

4. Liability & Risk Acknowledgment

By participating in any Aerialicious® activity, you acknowledge and agree that:

• You engage in classes, workshops, and retreats voluntarily and at your own risk.

• You have disclosed all relevant health information to instructors.

• You release and hold harmless Aerialicious®, its staff, contractors, and affiliates from any claims or damages arising from participation, except in cases of proven negligence.

• You are responsible for any personal injury or damage resulting from misuse of equipment or failure to follow instructions, and Aerialicious® will not be held liable for any costs arising from such.

• You understand that Aerialicious® is not responsible for loss, theft, or damage to personal belongings.
  

5. Conduct & Participation

Aerialicious® promotes a positive, inclusive, and supportive environment.
Participants agree to:

• Treat all instructors and others with respect.

• Use studio and aerial equipment responsibly.

• Avoid unsafe, disrespectful, or disruptive behaviour.

• Arrive on time and prepared for each session.

• Leave the training space clean and tidy. This includes packing up and cleaning of mats, grip residue or any other items or mess.
  

Failure to comply with these expectations may result in removal from the class or event without refund.

6. Media, Photography & Social Media

• Photos and videos may be taken by the Aerialicious® team during classes, workshops, or retreats for marketing and educational purposes.

• By participating, you grant Aerialicious® permission to use your image and likeness for promotional use unless you opt out in writing before your session.

• Students are welcome to record their progress for personal use, provided it does not disrupt class or include others without consent.

• No videography of instructors is permitted without explicit verbal permission on a case by case basis.

• All professional media created by Aerialicious® remains the property of the brand.

7. Retreats (International)

Applicable for all international locations.

• Travel Insurance: All participants are required to hold comprehensive travel insurance covering medical emergencies, cancellations, and lost baggage. 

• Passports & Visas: It is your responsibility to ensure valid travel documentation and visas.

• Schedule Changes: Aerialicious® reserves the right to adjust retreat schedules, accommodation, or instructors as needed.

• Health & Safety: Participants must comply with local health regulations and act responsibly during all activities.

• Assumption of Risk: International travel and aerial practice involve inherent risks; by joining, you accept full responsibility for your participation.

Aerialicious® will not be held liable for any costs related to travel or losses incurred due to flight delays, lost baggage, or lost income. 

Participants in all retreats are solely responsible for all travel related costs, including flights, travel insurance, visas, local transport, accommodation and meals, unless specifically stated as inclusions by Aerialicious® - please refer to individual retreat terms & conditions for full details of inclusions and exclusions.

8. Privacy & Data Protection

Aerialicious® collects personal information for bookings, communications, and safety purposes.
We use secure third-party systems, including GoHighLevel, SuperSaaS, Humanitix, and Stripe.
All personal data is managed according to our Privacy Policy.

9. Insurance & Security

Aerialicious® and its third-party providers use encrypted, compliant systems for all transactions and data storage.

Participants are strongly encouraged to maintain personal insurance coverage appropriate for their participation (including health and travel insurance for retreats).

10. Studio Hire Policy

Thank you for your interest in hiring our studio! We’re proud to share our space with creatives, performers, and instructors who value a safe and supportive environment. Please take a moment to review the following terms to ensure a smooth booking experience. By confirming your hire, you agree to the conditions below.

Booking & Payment

• Studio hire is available by the hour or half-day, subject to availability.

• All bookings must be made in advance and confirmed in writing.

• Full payment is required to secure your booking.

• Rates are inclusive of GST (10%) unless otherwise stated.

• Regular or long-term hire arrangements may be invoiced weekly or monthly by prior agreement.
  

Cancellations & Refunds

• Cancellations made more than 7 days before the booking will receive a full refund.

• Cancellations made within 7 days of the booking will incur a 50% cancellation fee.

• Cancellations made within 48 hours or “no-shows” are non-refundable.

• The studio reserves the right to cancel or reschedule due to unforeseen circumstances. In such cases, a full refund or credit will be offered.
  

Insurance & Liability

• All hirers must hold their own public liability insurance and provide proof upon request.

• The studio is not responsible for any personal injury, loss, or damage to personal property.

• Hirers are fully responsible for the conduct and safety of all participants during their booking.
  

Safety & Supervision

• Safety is our top priority. All aerial, acrobatic, or physical activity must be conducted under qualified supervision.

• The hirer must ensure all participants are appropriately trained and capable of using aerial or studio equipment safely.

• Rigging equipment is only to be operated by Aerialicious® Studios personnel, unless otherwise indicated. 

• Crash mats are to be used at all times, unless express permission is given in writing by Aerialicious®. 

• The studio reserves the right to refuse hire or terminate a session if safety protocols are not being followed.
  

Equipment & Studio Use

• Hire includes access to aerial points, mats, and sound system unless otherwise arranged.

• Please use all equipment safely and only as intended.

• If providing your own aerial equipment, Aerialicious® reserve the right to inspect all equipment for safety prior to use. Safety certificates must be provided on request. 

• Any damage to equipment or facilities caused during your hire will be charged to the hirer.

• Food, drinks, and shoes are not permitted on mats or aerial areas.

• All rubbish is to be disposed of in the bins provided. 

• Hirer is responsible for ensuring all mess is cleaned up at the end of the hire session. Failure to do so will incur a cleaning fee of $120 (GST inclusive).
  

Photography, Filming & Social Media

• Personal filming and photography during training sessions are welcome.

• Commercial shoots or professional projects must be approved in advance and incur additional fees.

• When sharing your content publicly, please credit or tag @Aerialiciousentertainment where appropriate.

• Filming other classes or individuals without consent is not permitted.
  

Alcohol & Substance Policy

• No alcohol, smoking, vaping, or recreational drugs are permitted within the studio or within 4 metres of the entrance.

• Anyone under the influence will be asked to leave immediately, and all hire fees will be forfeited.

• Use of smoke machines, candles, or any flammable materials is strictly prohibited.
  

Clean-Up & Exit

• Please return the studio to its original condition before leaving.

• Remove all personal belongings and rubbish.

• Ensure all lights, fans, and sound equipment are turned off at the end of your session.
  

Indemnity

By hiring the studio, you agree to indemnify and hold harmless Aerialicious®, its owners, and staff from any claims, damages, or expenses arising from your use of the space except where caused by Aerialicious’® own negligence.

Force Majeure

The studio shall not be liable for failure or delay in fulfilling its obligations if caused by circumstances beyond its reasonable control, including but not limited to fire, flood, power outage, government restrictions, or other emergencies. In such events, any prepaid hire fees may be rescheduled or credited at the studio’s discretion.

11.Social Media & Digital Media Policy (+ Model/Photography Release)

At Aerialicious®, we love celebrating the artistry, creativity, and progress of our community. From workshops to performances, we often capture moments that highlight the energy and spirit of our students and instructors. To ensure everyone feels comfortable and respected, we’ve outlined the following policy on photography, videography, and digital media use.

Photography & Videography

• Photos and videos may be taken by the Aerialicious® team during classes, workshops, and events for marketing, promotional, and educational purposes.

• These materials may appear on our website, social media platforms, newsletters, and other digital or print materials.

• By attending any class, workshop, or event, you grant Aerialicious® permission to use your image and likeness for these purposes unless you explicitly request otherwise.

• If you prefer not to be photographed or filmed, please inform us in writing before your session begins. We will make every effort to respect your request.
  

Personal Recording & Community Sharing

• Students and guests are welcome to record or photograph their own training progress for personal use, provided it is done safely and does not disrupt the class or event.

• Out of respect for others, please do not capture or share images or videos of other participants without their explicit consent.

• Content recorded at Aerialicious may not be used for commercial or paid promotional purposes without written permission from the studio.

• No videography of instructors is permitted without explicit verbal permission on a case by case basis. If you wish to film your instructor demonstrating, please request their permission in each instance. 

• When posting your own content, we encourage you to tag us  @aerialiciousstudio and use our official hashtags to help spread the love and support within the community.
  

Model & Photography Release

By participating in any Aerialicious® activity, you acknowledge and agree that:

1. Aerialicious® and its team or contractors own the rights to all photos, videos, and digital content created by them.

2. These materials may be used, reproduced, published, or distributed by Aerialicious for marketing, advertising, or educational purposes without compensation.

3. You waive any right to inspect or approve the final materials or their use.

4. You may withdraw consent for future use at any time by submitting a written request (this does not apply retroactively to already published materials).
   

Respect & Safety Online

We encourage our community to share their Aerialicious® journey in a positive and respectful way.

• Bullying, harassment, or posting misleading or inappropriate content that misrepresents the studio or its members will not be tolerated.

• Aerialicious® reserves the right to request the removal of any online content that compromises privacy, safety, or brand integrity.
  

Media Collaborations & Commercial Shoots

We welcome collaborations with photographers, influencers, and brands that align with the Aerialicious® spirit and values.

• All commercial or promotional filming, photography, or content creation within the studio must be pre-approved in writing by Aerialicious® management.

• Approved collaborators must agree to our safety standards, respect the privacy of other studio users, and ensure that all branding and content accurately represent the Aerialicious® name.

12. Force Majeure

Aerialicious® shall not be held responsible for cancellations or disruptions caused by events beyond its control, including but not limited to natural disasters, pandemics, or government restrictions.

11. Governing Law

These Terms and Conditions are governed by the laws of Australia, and any disputes shall be subject to the jurisdiction of Australian courts.

12. Agreement & Acknowledgment

By booking, paying for, or attending any Aerialicious® class, workshop, private lesson, or retreat, you:

• Confirm that you have read and understood these Terms and Conditions.

• Agree to abide by all studio and instructor policies.

• Acknowledge the assumption of risk and waiver of liability.
